  • MemoriaSoft collects personal information such as names, contact details, and event information to provide services.
  • Uploaded content (messages, photos, videos) is accessible to the next of kin (administrator) and anyone with the shared link, unless set as private.

5. User Rights

  • You have the right to access, modify, or delete your personal data at any time.
  • You can request a copy of all data associated with your account.
  • You can withdraw consent for data processing, which may limit service functionality.
  • You have the right to portability of your data in a commonly used format.

6. Content Sharing and Visibility

  • Memorial content can be made public (accessible via shared link) or private (restricted access).
  • The next of kin has administrative control over content visibility and user permissions.
  • Public memorials may be discoverable through search engines unless privacy settings restrict this.

7. Public Content and Community Guidelines

  • All public content must be respectful, appropriate, and in good taste.
  • Content that is offensive, harmful, or inappropriate will be removed.
  • Users are encouraged to report inappropriate content for review.
  • We reserve the right to moderate and remove content that violates our community guidelines

  • Subscription fees are charged in advance and are non-refundable except as required by law.
  • Prices may change with 30 days’ notice to existing subscribers.

12. Service Availability and Support

  • We strive to maintain 99.9% service uptime but cannot guarantee uninterrupted service.
  • Scheduled maintenance will be announced in advance when possible.
  • Technical support is available via email and online resources.
  • Emergency support may be limited during certain hours.

13. User Conduct and Prohibited Activities

  • Users must not engage in harassment, spam, or abusive behavior.
  • Impersonation of others or creation of fake profiles is prohibited.
  • Commercial use of the platform without permission is not allowed.
  • Users must not attempt to breach security or access unauthorized areas.

14. Disclaimers and Limitations of Liability

  • MemoriaSoft is provided “as is” without warranties of any kind.
  • We are not liable for user-generated content or interactions between users.
  • Our liability is limited to the maximum extent permitted by law.
  • We do not guarantee that the service will meet all user requirements or be error-free.

15. Intellectual Property Rights

  • Users retain ownership of their uploaded content but grant MemoriaSoft necessary licenses to provide services.
  • The MemoriaSoft platform, software, and branding are our intellectual property.
  • Users must not copy, modify, or distribute our proprietary technology.
  • Reported copyright infringement will be investigated and addressed promptly.

16. Governing Law and Dispute Resolution

  • These terms are governed by the laws of Malta.
  • Disputes will be resolved through binding arbitration or competent courts in Malta.
  • Users waive the right to participate in class action lawsuits.
  • Any legal proceedings must be initiated within one year of the dispute arising.
